Chatbot and data collection on client websites:

Agencies using the HDKN platform may deploy a conversational assistant (chatbot) on their websites. When interacting with this chatbot, visitors may provide personal information (first name, last name, email address, phone number, conversation content). This data is collected and processed to respond to requests and improve service quality. The client agency is the data controller under the GDPR for the data collected. HDKN acts solely as a technical processor and does not reuse this data for its own purposes. Visitors wishing to exercise their rights must contact the relevant agency or organization directly.

ARTICLE 4 – PURPOSE OF THE PLATFORM
app.hdkn-solutions.com is a SaaS (Software as a Service) digital management platform intended for web and communication agencies.
It enables agencies to manage their clients’ online presence through various modules (Website & SEO, Google My Business, AI Chatbot, Online Booking, Community Management, AI Receptionist, Advertising).
HDKN provides the platform to partner agencies.
End customers access the platform through their respective agency.
HDKN has no direct contractual relationship with end customers.

ARTICLE 5 – INTELLECTUAL PROPERTY
All elements of the platform (source code, interfaces, graphics, texts, logos, architecture) are the exclusive property of HDKN EURL and are protected by French and international intellectual property laws.
Any reproduction, representation, modification, publication or adaptation of all or part of these elements, regardless of the means or process used, is prohibited without prior written authorization from HDKN.

ARTICLE 6 – PERSONAL DATA AND GDPR
HDKN processes personal data in the context of providing its services, in accordance with the General Data Protection Regulation (GDPR – EU 2016/679) and the French Data Protection Act.

ARTICLE 2 – PURPOSE
These Terms and Conditions of Sale exclusively govern the contractual relationship between HDKN and agencies (hereinafter the “Agency”) subscribing to access to the HDKN SaaS platform (hereinafter the “Platform”), accessible at app.hdkn-solutions.com.
The Platform is a digital management tool made available to agencies to enable them to manage the online presence of their own clients.
HDKN has no direct contractual relationship with the agencies’ end customers.

ARTICLE 3 – ACCESS TO THE PLATFORM
3.1 Agency Account
The Agency subscribes to access to the Platform allowing it to manage its clients, activate modules on their behalf, create commercial offers and monitor performance via available dashboards.

3.2 User Accounts
The Agency may create accounts for its employees (administrators, sales staff) as well as for its end customers.
The Agency is solely responsible for their use.

3.3 Available Modules
The Platform offers the following modules, which can be activated by the Agency on behalf of its clients:

Website + SEO
Google My Business
AI Chatbot
Online Booking
Community Management
AI Receptionist
Advertising

ARTICLE 4 – PRICING AND BILLING
4.1 Pricing
Pricing conditions for access to the Platform are contractually defined between HDKN and each Agency.
All prices are expressed in euros excluding taxes.

4.2 Billing
Billing is monthly.
Invoices are accessible from the Platform’s super administrator area.

4.3 Payment
Payment is made according to the terms defined in the contract signed between HDKN and the Agency.
In the event of non-payment, HDKN reserves the right to suspend access to the Platform after formal notice remains unanswered for 15 days.

ARTICLE 5 – RESPONSIBILITIES
5.1 HDKN Responsibility
HDKN undertakes to ensure Platform availability with a target of 99% (excluding scheduled maintenance), to secure hosted data and to perform regular backups.
HDKN cannot be held responsible for the commercial results obtained by the Agency or its clients through use of the Platform, nor for interruptions due to external causes (force majeure, network failure, third-party service failure).

5.2 Agency Responsibility
The Agency is solely responsible for its commercial relationship with its clients, the content published via the Platform, compliance with legal obligations towards its clients (terms and conditions, legal notices, GDPR) and proper use of access credentials.
HDKN cannot under any circumstances be held responsible for disputes between the Agency and its clients.

ARTICLE 6 – PERSONAL DATA
HDKN processes personal data in accordance with the GDPR (EU 2016/679).
Data relating to Agencies and their clients hosted on the Platform is used exclusively for service provision.
The Agency acts as data controller with respect to its own clients.
HDKN acts as a data processor within the meaning of the GDPR.
A data processing agreement may be established upon request.

ARTICLE 7 – INTELLECTUAL PROPERTY
The HDKN Platform, its source code, interfaces and all its components are the exclusive property of HDKN.
The Agency is granted a limited, non-exclusive and non-transferable right of use for the duration of the contract.

ARTICLE 8 – TERM AND TERMINATION
The contract is concluded for the duration agreed between the parties.
It is automatically renewed on a monthly basis unless terminated in writing with one month’s notice.

ARTICLE 9 – APPLICABLE LAW AND DISPUTES
These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the courts within the jurisdiction of Mulhouse (France) shall have exclusive jurisdiction.

ARTICLE 1 – INTRODUCTION
HDKN EURL (hereinafter “HDKN”) places the highest importance on the protection of its users’ personal data. This Privacy Policy describes how HDKN collects, uses, stores and protects personal data in connection with the use of the platform app.hdkn-solutions.com. It applies to all users of the platform: partner agencies, agency employees and agencies’ end customers.

Within the relationship between agencies and their end customers, HDKN acts as a data processor within the meaning of the GDPR. The agency is the data controller with respect to its own customers.

ARTICLE 4 – PURPOSES OF PROCESSING
Personal data is collected and processed for the following purposes:

Service improvement: usage analysis to optimize the platform
Legal obligations: data retention required by law

For transfers outside the EU (OpenAI, Google), HDKN ensures appropriate safeguards are in place (Standard Contractual Clauses of the European Commission). No data is sold or transferred to third parties for commercial purposes.

ARTICLE 7 – RETENTION PERIOD
Active account data: duration of the contract
Data after termination: 3 years
Billing data: 10 years (legal obligation)
Connection logs: 12 months
Session data: 30 days

ARTICLE 8 – DATA SECURITY
HDKN implements the following technical and organizational measures:

Password hashing (bcrypt)
Encrypted automatic backups every 6 hours
Role-based access control (RBAC)
Sensitive action logging (audit logs)
Hosting on secure Infomaniak infrastructure (ISO 27001)
