Agency.<br \/>All prices are expressed in euros excluding taxes.<\/p>\n<p>4.2 Billing<br \/>Billing is monthly.<br \/>Invoices are accessible from the Platform\u2019s super administrator area.<\/p>\n<p>4.3 Payment<br \/>Payment is made according to the terms defined in the contract signed between HDKN and the Agency.<br \/>In the event of non-payment, HDKN reserves the right to suspend access to the Platform after formal notice remains unanswered for 15 days.<\/p>\n<p>ARTICLE 5 \u2013 RESPONSIBILITIES<br \/>5.1 HDKN Responsibility<br \/>HDKN undertakes to ensure Platform availability with a target of 99% (excluding scheduled maintenance), to secure hosted data and to perform regular backups.<br \/>HDKN cannot be held responsible for the commercial results obtained by the Agency or its clients through use of the Platform, nor for interruptions due to external causes (force majeure, network failure, third-party service failure).<\/p>\n<p>5.2 Agency Responsibility<br \/>The Agency is solely responsible for its commercial relationship with its clients, the content published via the Platform, compliance with legal obligations towards its clients (terms and conditions, legal notices, GDPR) and proper use of access credentials.<br \/>HDKN cannot under any circumstances be held responsible for disputes between the Agency and its clients.<\/p>\n<p>ARTICLE 6 \u2013 PERSONAL DATA<br \/>HDKN processes personal data in accordance with the GDPR (EU 2016\/679).<br \/>Data relating to Agencies and their clients hosted on the Platform is used exclusively for service provision.<br \/>The Agency acts as data controller with respect to its own clients.<br \/>HDKN acts as a data processor within the meaning of the GDPR.<br \/>A data processing agreement may be established upon request.<\/p>\n<p>ARTICLE 7 \u2013 INTELLECTUAL PROPERTY<br \/>The HDKN Platform, its source code, interfaces and all its components are the exclusive property of HDKN.<br \/>The
